SmartDreams™ Privacy Notice

This Privacy Notice provides you with an important overview of how SixD Inc. (“SixD”, “we”, “us” and “our”) handles your information, with whom we share it, and what your rights and choices are with respect to the information we process about you when you interact with our SmartDreams™ mobile application (the “App”). We encourage you to read our Privacy Notice so you can use our App in the way that’s right for you. Our App may contain hyperlinks to websites operated by others whose privacy practices may differ from ours. Our Privacy Notice only applies to our App, and we encourage you to review the privacy notices of any other website you are redirected to from our App, as we have no control over information that is submitted to or collected by these third-parties.

The App is provided to general audiences, including parents and guardians of children, but is not intended to be used directly by children. We are sensitive to your concerns about children’s safety and privacy.

If we update our Privacy Notice, we will post the updated Privacy Notice on this page and update the “Last Updated” date. We encourage you to review our Privacy Notice periodically for changes. If we make material changes to our privacy practices, we will notify you in advance, or you will otherwise have the opportunity to review the revised Privacy Notice before you choose to continue using our App.

  1. WHAT INFORMATION WE COLLECT ABOUT YOU AND HOW IT IS COLLECTED.
  2. We need certain types of information so that we can provide you with the App. If you do not provide us with such information, you may no longer be able to access or use the App.
      Information You Provide to Us Directly: We collect various types of information directly from you when you provide it to us for the following purposes:
      • In order to set up an account to use our App, you need to provide us with an email address and password. If you do not provide this information, we will not be able to set up and administer an account for you to use our App.
      • When you submit content to our App, including by submitting the name, gender and age of the character you want the App to generate a story about, we will collect the information you submit to enable you to use the feature of the App you have requested. If you post content about other individuals, we will also collect that information. It is your responsibility to determine whether you have permission to submit information about other people to our App. We will only use the content you provide to create stories for the purpose of generating the customized story you have requested through the App.
      • If you contact our customer support and technical assistance team, we will collect the name, contact information, and any other information you choose to provide us in the content of your message to respond to your inquiry.
        Information Collected Through Automated Means: When you interact with our App, we may automatically collect information about your use of our App and the devices you use to access our App, including your IP address, device type, device ID, Internet Services Provider, general location information, page views, a date/time stamp, browser type, referring/exit URLs, operating system, error logs, and similar device and usage information.

        Cookies: To collect the information in the “Information Collected Through Automated Means” section above, we and our service providers may use Internet server logs, cookies, tracking pixels, and other similar tracking technologies. We use these technologies to recognize you and/or your devices in order to offer you a more tailored experience in the future by understanding and remembering your particular browsing preferences. A cookie is a small piece of data that your internet browser places on your device so that it can be recognized when it returns in the future. We use cookies and similar technologies to secure our App, remember your preferences, and personalize content for your future visits. Most browsers automatically accept cookies, but you can usually refuse cookies or selectively accept certain cookies by adjusting the preferences in your browser. If you turn off or refuse cookies, there may be some features of our App that will not be available to you, and some portions of our App may not display properly or be less personalized. You will not be able to opt-out of any cookies or other technologies that are “strictly necessary” for our App to function.

        Do-Not-Track Signals: Your browser may allow you to set a “Do Not Track” preference. The App currently does not respond to “Do Not Track” or similar signals.

  3. HOW WE USE YOUR INFORMATION.
  4. We primarily use your information to provide you with the App as you have requested. In addition, we may use your information to:
    • Respond to your requests for information and provide you with customer service.
    • Promote the safety, security and integrity of our App. We may use your information to verify accounts and activity as well as to help detect and prevent issues relating to security, fraud, and inappropriate activity on our App, including investigating or addressing alleged misbehavior
    • Develop, research and test improvements to our App. For example, we use your information to see if our App is working properly and troubleshoot issues. We may also use your information to analyze trends in connection with usage of the App or to test out new products and features for our App.
    • Personalize the features and content. We may use your information to customize the content we may send or display on the App to personalize your experience
    • Communicate with you by email or mobile device about products or services that we think may interest you (unless you have indicated to us that you do not wish to receive such information). Please see section 7 regarding your choices and right to opt out of our marketing messages.
    • Meet our legal compliance and regulatory duties, including assisting law enforcement.
    • Establish, exercise, or defend our legal rights where it is necessary for our legitimate interests or the legitimate interests of others.
    We do not sell any of your information to anyone. We do not disclose your contact information to third parties for their own marketing purposes. Where permitted by applicable law, we may de-identify, aggregate, or anonymize information so that it no longer identifies you and use it for any purpose.

  5. HOW WE SHARE YOUR INFORMATION.
  6. In general, we only share your information as follows:
    • Our Services Providers. We use third parties to help us operate and improve our App. These third parties assist us with various tasks, including data hosting and maintenance, analytics, customer care, marketing, advertising, payment processing and security operations. All of our service providers and partners must agree to strict confidentiality obligations.
    • For Corporate Transactions. We may transfer your information if we are involved in a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control, including without limitation, during the course of any due diligence process.
    • When Required by Law. This may include if we need to comply with a subpoena, bankruptcy proceedings, or similar legal process, or in response to lawful requests by public authorities.
    • To Enforce Legal Rights. We may also share information to investigate, prevent, or take other action regarding illegal activity, suspected fraud, violation of our Terms or legal rights, or other wrongdoing.
    • With Your Consent or at Your Request. We may ask for your consent to share your information with third parties. In any such case, we will make it clear why we want to share the information.

  7. HOW YOUR INFORMATION IS STORED.
  8. We control and operate the App from the U.S. Our Privacy Notice and practices are governed by the laws of the U.S., which may differ from privacy laws in your state or home country. If you choose to use the App from outside the U.S., please note that you are transferring information to a country and jurisdiction that do not have the same data protection laws as your jurisdiction. By providing us with your information, you acknowledge any such transfer, storage, or use.

    We maintain industry standard administrative, technical, and physical safeguards to protect your personal information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. With that said, no method of data transmission online is completely secure, and we cannot guarantee its absolute security.

    In general, we will only retain your information for the time necessary to realize our legitimate business purposes and to comply with the law. We may retain your information in order to prevent, investigate, or identify possible wrongdoing in connection with our App or to comply with legal obligations. We may also maintain residual copies of your personal information in our backup systems.

  9. EXERCISING YOUR PRIVACY RIGHTS.
  10. Depending on your jurisdiction of residence, you may have certain rights with respect to your information. Please contact us at the information below to submit such a request, and we will process it in accordance with applicable law.

  11. CHILDREN’S PRIVACY.
  12. The App is intended to be used by a general audience, including parents and guardians of children. While the App is not intended for direct use by children, we recognize that children may use the App with their parent’s or guardian’s consent.

    If you are a child under 13, please do not send any personal information about yourself to us without your parent’s or guardian’s consent. We collect certain types of personal information from children, including name, age, gender, and profile photo, for the purpose of providing personalized features within the App.

    To comply with the Children’s Online Privacy Protection Act (COPPA), we obtain verifiable parental consent before collecting personal information from children under the age of 13. Parents or guardians must acknowledge and agree to the collection and use of their child’s information by checking a consent checkbox during the account creation process. The checkbox indicates that the parent or guardian agrees to our collection of their child’s information for use within the App only, and that the information will not be shared with third parties for advertising or any other purposes.

    If we become aware that we have inadvertently collected personal information regulated by COPPA from children under the age of 13 without valid parental consent, we will take reasonable steps to delete it as soon as possible. We also comply with other age restrictions and requirements in accordance with applicable local laws.

    Parents and guardians have the right to review, correct, and delete their child’s personal information. To exercise these rights or for any questions regarding our privacy practices related to children, please contact us at eric.taylor@renee.com.

  13. USER DATA DELETION.
  14. We respect your right to control your personal data. If you wish to request the deletion of your personal data from our app, you may do so by sending us an email at eric.taylor@renee.com. To submit a data deletion request, please include the following information in your email:
    • Your full name
    • The email address associated with your account
    • A clear statement that you are requesting the deletion of your personal data
    Upon receiving your request, we will take steps to delete your personal data from our systems in accordance with applicable legal requirements. Please note that the deletion process may take some time to complete, and certain legal obligations or record-keeping requirements may require us to retain some of your data for a specified period of time.

  15. OPTING OUT OF MARKETING MESSAGES.
  16. If we send you marketing communications, you can opt out at any time by selecting the “unsubscribe” link in the e-mail or contacting us. Please note that some non-marketing communications are not subject to general opt-out, such as service updates relating to the App, sales transactions, software updates and other support related information, patches and fixes.
